The role of law is important at all stages of the planning, design and implementation of water management systems. A number of concrete legal issues must be addressed, such as ownership of the water, shared responsibilities, possible injuries for actions and uses by one state, mechanism for cooperation among riparian states, allocations and restrictions for different uses, and methods for peaceful settlement of disputes. Applying an appropriate legal framework promotes efficient management and helps avoid or settle conflicts between competing water users and their interests. Therefore, in this research, firstly, are introduced important international rules about the method of governance and utilization of shared rivers. In the next step, is studied each of the trans boundary rivers (Tigris, Euphrates, Arvandrud, Hirmand, Heriroud, Aras, Atrak) in Iran country. Finally, Will be presented recommendations for the better development and management of the rivers. the Studies have shown that some of poor management returned to the economic, social and political relations of Iran with other neighbor countries, and as a result from previous studies it can be declare that Considering the available international rules and the condition of exploitation of countries with shared resources, societies and the state must move towards a rational and appropriate use with the right of sustainable development for both sides.}, keywords = {International Water Utilization Law,Integrated Water Resources Management,Trans boundary Rivers of Iran}, title_fa = {بررسی چارچوب‌های مقرراتی و سازمانی به‌منظور مدیریت یکپارچه منابع آب در حوضه‌های رودخانه‌ای مشترک با تاکید بر رودخانه‌های مرزی ایران}, abstract_fa = {مدیریت یکپارچه منابع آب، به عنوان فرآیندی که موجب ترویج، توسعه و مدیریت هماهنگ آب، زمین و منابع مرتبط درسطح حوضه رودخانه می­شود، نیازمند یک چهارچوب قانونی موثر برای فراهم آوردن قوانین و روش­‌های شفاف است. نقش قانون در کلیه مراحل برنامه­‌ریزی، طراحی و اجرای سیستم­‌های مدیریت آب، اهمیت زیادی دارد. تعدادی از مباحث قانونی سخت در این زمینه شامل مالکیت آب، مسئولیت­‌های مشترک، آسیب­های ممکن برای فعالیت­ها و استفاده­های یک کشور، مکانیسم­های همکاری در بین کشورهای همسایه، تخصیص و محدودیت­‌ها برای استفاده‌­های مختلف، و روش‌­هایی برای حل مسالمت‌­آمیز اختلافات، باید شناخته شوند. به‌­کار گرفتن یک چهارچوب قانونی مناسب، مدیریت موثر را ارتقا داده و به اجتناب یا حل اختلافات بین آب­بران رقیب و منافع آنها کمک می‌­نماید. لذا در این تحقیق ابتدا قوانین بین‌­المللی مهم در خصوص نحوه حاکمیت و بهره­برداری از رودخانه­‌های مشترک مرزی معرفی می‌­گردد. در گام بعدی هر یک از رودخانه‌­های مرزی (دجله، فرات،‌ اروندرود، هیرمند، هریرود، ارس، اترک) کشور ایران مورد مطالعه قرار می­گیرد و در نهایت برای هریک از آن‌ها پیشنهاداتی در جهت توسعه و مدیریت بهتر این رودخانه­‌ها ارائه خواهد شد. مطالعات صورت گرفته نشان می­دهد که برخی از مدیریت‌­های ضعیف در این‌­باره به روابط اقتصادی، اجتماعی و  سیاسی کشور ایران با دیگر کشورهای همسایه برمی­گردد و به عنوان یک نتیجه از بررسی­‌های انجام­ شده می­توان بیان کرد که با توجه به قوانین بین­‌المللی موجود و وضعیت بهره‌­برداری کشورهای دارای منابع مشترک، باید جوامع و دولت­‌ها به سمت استفاده منصفانه و معقولانه همراه با حق توسعه پایدار برای طرفین پیش­ بروند.}, keywords_fa = {قوانین بین‌المللی بهره‌برداری آب,مدیریت یکپارچه منابع آب,رودخانه‌های فرامرزی ایران}, url = {https://www.wmji.ir/article_696797.html}, eprint = {https://www.wmji.ir/article_696797_763c00092ac244c015473e26b12a4fa8.pdf} }
